Disney Movie Rewards Program ("the Program")

TERMS AND CONDITIONS

PLEASE READ CAREFULLY. By joining the Program you agree to the following terms and conditions.

  • A. Overview of the Disney Movie Rewards Program

    The Program is a loyalty program sponsored by Walt Disney Studios Home Entertainment (UK & Ireland), a division of The Walt Disney Company Ltd registration number 530051 registered office at 3 Queen Caroline Street, Hammersmith. London, W6 9PE ("Disney" or "We" or "Us"). The Program is available online at at www.DisneyMovieRewards.co.uk ("the Website").You can collect points by purchasing selected Disney DVDs or Disney Blu-ray discs which contain unique codes inside (subject to availability) or through participating in other activities to obtain codes as may be added to the Program from time to time. You must register on the Website to set up your online account and then once you have collected enough points in your account you can redeem your points for rewards shown in the Rewards Catalogue available online.

  • B. Eligibility

    You must be 18 or over to join the Program and a resident of Great Britain (England, Wales and Scotland), the Channel Islands, the Isle of Man or the Republic of Ireland.

    Employees of Disney or its affliates, their families, agencies and anyone else directly connected with the Program may not participate in the Program.

    We reserve the right to refuse any application to join that we believe breaches these Terms or for any other good reason.

    Applications from trade customers or any consumer group will not be accepted.

    The Program is void where prohibited by local applicable law.

  • C. Duration of Program

    The Program starts on 26 October 2009 and closes on 25 October 2010, 11.59 pm ("the Closing Date"). Codes can be entered at any time up to the Closing Date only and you may redeem your points up to 4 weeks after the Closing Date. We reserve the right to shorten, extend, modify, or cancel the Program, in our discretion, at any time. If we decide to cancel the Program prior to the Closing Date or any time after that date we will notify you via the email address which you have supplied us. See further Sections H and K below which sets out our rights to terminate the Program or cancel your account.

  • D. Enrolling in the Program

    If you are eligible you may register to join the Program via the Website. To register, click on the "Join Now" button near the top of the home page and follow the onscreen instructions to create your account. You must have a unique valid email address to create your account and there is a limit of one (1) account per person. You are responsible for ensuring that your account information is accurate and up to date. We are not responsible for anything which arises because of any inaccurate information which you provide.

    Once your account has been set up, you will be registered as a participant in the Program. The number of points you collect will be recorded and tracked in your account. You will need your Username (normally your email address) and Password to login to your account so make sure you keep them safe.

  • E. Collecting Points

    You can collect points by purchasing selected Disney DVDs or Disney Blu-ray discs which contain unique codes inside (subject to availability) or through participating in other activities to obtain codes as may be added to the Program from time to time. You can locate the code inside the packaging from one of the eligible titles (please see Website for list of current titles). You should then go to the Website and follow the links and instructions to either register or login to your account (if you have registered and set up your account already) by entering your email address and password on the home page then click on the Go button. After registering/logging in, enter your code(s) where indicated.

    When you have collected sufficient points you can redeem them against available rewards. The number of points required for each reward is listed in the Rewards Catalogue available on the Website. We reserve the right to change, add, or remove the methods by which you can collect points and the number of points awarded for purchases at any time - see section K for further details on how we will notify you of any changes.

    If you have purchased an eligible Disney DVD or Disney Blu-ray disc which does not contain a code or you have lost the code, visit the "Eligible Movies" page and click on the "Missing a Code" link. To claim your points please fill out the Contact Us form and submit it to Customer Services. You will need to give us details about the name of the movie which you bought, whether it was a DVD or Blu-ray, where you bought it and when. We reserve the right to verify your claim and we may ask you to provide your original receipt and/or other proof of purchase. Once your claim has been verified we will send you an email with a Magic Code for you to input to get your points.

    Codes can only be used once and there is a limit of one (1) code per title per format (DVD, Blu-ray etc.).

    You cannot enter more than 10 invalid codes within a twenty-four (24) hour period. If you do this will lock your account and we may decide to close your account.

    Points can only be collected or redeemed as set out in these Terms or on the Website. You may not sell, auction (for example you cannot sell your points on eBay or other similar auction sites), transfer or exchange points and any attempt to do so is a serious breach of these Terms. You may not combine or transfer points between accounts. Any attempt to combine or transfer codes or points will result in disqualification from the Program, closure of your account and cancellation of all unused points - see Section H for further details. We reserve the right to take any other action we think is appropriate in our discretion if we believe that any member has violated this or any of these Terms.

    All codes (and the points which are earned from the codes) are subject to verification, so we recommend that you always retain your original receipt or other proof of purchase and the original code document. We reserve the right to invalidate points and not add them to your account (or deduct them at a later date) if any code or associated points cannot be verified or are subsequently found to be invalid. Codes are void if not obtained in accordance with these Terms or are counterfeit or have been tampered with.

    We will not be held responsible for any unauthorised use of the codes you collect or the points logged in your account. This does not affect or limit our liability under Section J below.

    If you believe that points have not been properly credited to your account, you must notify Customer Services within fifteen (15) days of inputting the code. Contact Customer Services by clicking the Contact Us link on any of the Website pages.

    Validated codes, original receipt(s) or proofs of purchase that are subsequently determined to be invalid for any reason are subject to disqualification and the corresponding points will be deducted from your account.

    If your account is inactive for 270 or more days your points will expire. This means that your point balance will be wiped to zero (without compensation) if you have not logged in to your account or entered a code in the last 270 days. We will inform you by email to forewarn you about when this will happen.

    Our decision to award or invalidate any points is final and binding on you.

  • F. Redeeming Points

    You may redeem your points for merchandise, discounts, offers and other items ("the Rewards") listed in the online Rewards Catalogue available via the Website. All Rewards are subject to availability. The Website will list the corresponding point value required to redeem each item. We reserve the right to modify the list of Rewards and/or their corresponding point values, at any time. Points have no cash value and are only redeemable for offered Rewards via the Program.

    To redeem your points, review the online Rewards Catalogue. You may select any Reward still available and in stock for which you have accumulated sufficient points for redemption. Click the "Redeem" button corresponding to the item you wish to redeem and follow the links and instructions to complete the redemption process. As part of the redemption process, you will receive a confirmation email. Emails and digital Rewards will be sent to the email address assigned to your account.

    Rewards cannot be exchanged or transferred. No cash alternative in whole or in part is available.

    Points may be revoked at any time by Disney in accordance with these Terms.

    You are responsible for the payment of any tax which may be payable as a result of receiving any Reward.

  • G. Returning Rewards & Your Right to Withdraw

    You have a "cooling off" period of 14 working days to return any Rewards free of charge which you do not want for any reason. In the unlikely event you wish to return a Reward which has been delivered to you please follow the returns instructions which you will receive when you first receive the Reward. Your 14 days will start to count down from the day after you physically receive the Reward. Your right to return applies to all Rewards except for digital items (which you downloaded or received by email) and DVDs, Blu-ray discs, audio, games or software products which have been unsealed. In addition some Rewards which are personalised or consist of services which we have provided to you or we have already begun to perform the services, may also not be cancelled.

    We will only accept undamaged items provided they are returned in the original packaging. Please package the item you wish to return securely and send it to us using the return label provided so that we receive it within the permitted returns period. We also recommend that you obtain an official proof of postage to show that you posted the item in case we do not receive it. We will arrange to collect large items which cannot be sent easily by mail - please contact Customer Services.

    Please note that you will be responsible for the costs of returning the item to us unless:

    we are responsible for these costs as set out in this Section G or

    we delivered the item to you in error, or if the item is damaged or defective or if the item is clothing, footwear or headwear and is not the correct size. Where this happens you have up to 30 days to return the item to us.

    We will take into account that you may have used the item and then discovered that it was faulty. If we do not receive the item back from you with the delivery slip, we may arrange for collection at your cost.

    If you are not happy with the quality of your Reward please check to see if there is an original manufacturer's guarantee or warranty which has been provided with the item and contact the manufacturer if you experience any fault.

    Once we begin the delivery process you will not be able to cancel any redemption you have selected via your account. You will have to wait to receive the Reward and then return it in accordance with the returns process set out in this Section G.

    Once the item has been validly returned we will credit your account with the same number of points which you originally redeemed for the Reward.

  • H. Termination of the Program and/or Cancellation of Your Account

    The Program starts on 26 October 2009 and closes on 25 October 2010, 11.59 pm ("the Closing Date"). Codes can be entered at any time up to the Closing Date only and you may redeem your points up to 4 weeks after the Closing Date.

    We reserve the right to shorten, extend, cancel, modify or suspend the Program, in our discretion, in whole or in part at any time. If we decide to cancel the Program prior to the Closing Date or any time after that date we will notify you via the email address which you have supplied us. See Section K for further details.

    We will always give you at least 4 weeks to use any unredeemed points in your account unless circumstances outside of our control require us to shorten the redemption period. Any points remaining in your account after the Closing Date which you do not redeem during the permitted redemption period will be cancelled without compensation.

    We reserve the right in our discretion to wipe your points balance to zero and/or cancel your account if you tamper with the code input or redemption process or the material operation of the Program or Website, as these are serious breaches of these Terms. For any other breaches of these Terms then we will assess the seriousness of the breach to determine how we should treat you and whether the breach warrants the cancellation of your account.

  • I. Your Personal Information

    The Program is subject to the Privacy Policy which is published on the Website. By ticking the check box "I agree that my personal data is stored in accordance with the Privacy Policy" during your initial registration with the Program, you signify your consent that we store and process your personal data in accordance with the Privacy Policy.

    You are responsible for ensuring the accuracy of your personal information so please check your account regularly. You should keep confidential any codes, usernames, passwords or other personal information.

    Your account page will include a Message Centre which will contain marketing messages about the Program and related offers which may be of interest to you - you can choose whether or not to open and read any of these messages. All messages automatically expire and are deleted 45 days after posting.

  • J. Our Liability to You

    Except for death or personal injury caused by the negligence of Disney, its employees or agents (or for any other liability which cannot be legally avoided or excluded), neither Disney, its employees or agents are responsible or liable for any loss which you may incur resulting from:

    Any incorrect or inaccurate code entry or for any faulty or failed electronic data transmissions;

    Any unauthorised access to, or theft, destruction or alteration of codes at any point in the operation of the Program;

    Any printing error or irregular packaging;

    Any failure to fulfil obligations of any third parties involved in the Program, although we will endeavour to minimise the effect on you where we control the third party;

    Communication or systems failures, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers use in any aspect of the Program;

    Inaccessibility, unavailability or other failure of the internet and/or the Website;

    Any damage to your or any other person's computer which may be related to or resulting from participating in the Program;

    Any harm or loss suffered as a result of failing to comply with any instructions issued by us or any manufacturer of a Reward or failing to exercise care when using the Reward; or

    Any other matter outside Disney's reasonable control.

    If we improperly deny you any points or agree to accept liability for the provision or (or failure to provide) a Reward validly redeemed, then our liability will only be to credit your account with the equivalent amount of points.

    We are not responsible for any products and/or services which are offered or made available directly to you through the Website by any third party promoters.

  • K. Changes to these Terms

    We reserve the right to change, modify, add to or delete at any time, any of these Terms. We will notify you of any changes to these Terms by sending you the amended version of these Terms by email, to the address which you have supplied us.The most current version of these Terms will be available at all times on the Website so please check the Website regularly to keep up to date.

    If we make any material changes to these Terms then those changes will only be effective as follows:

    We will notify you of the change(s) and will send you an amended version of these Terms by email

    If you do not object to the amended Terms within 4 weeks following the receipt of the email containing the amended Terms, the continued use of the Program by you will mean that you accept the change(s) and the amended Terms. We will advise you in the email that your continued participation in the Program after 4 weeks means that you accept the change(s) unless you notified us that you object to the change(s);

    If you have notified us correctly that you object to the change(s) then we reserve the right to terminate your account by giving you a further 4 weeks' notice (see section H).

    Material changes includes for example, the duration of the Program, the methods of collecting points, the eligible products to be purchased, the number of points associated with the purchase of eligible products or other activities, the number of purchases through which points may be collected, the number of points that may be redeemed, and any of the options available with respect to your account.

  • L. General Terms and Conditions

    These Terms, the Privacy Policy and any other terms and conditions published on the Website set out the complete agreement between you and us and no other terms and conditions or other understandings apply.

    If we choose not to enforce any of these Terms at any time then this does not invalidate the remaining terms nor does it mean that we have waived our right to enforce any of them at a later time.

    If any of these Terms is found to be invalid or cannot be relied on this does not mean that the remaining terms are invalid.

    If you have any questions about these Terms or the operation of the Program please read the FAQ section available on the Website. If you still need help then please contact Customer Services. Any question or dispute regarding eligibility for the Program, collecting or redemption of points, or your compliance with these Terms will be resolved by Disney in its sole discretion, whose decision will be final.

    These Terms and the operation of the Program are governed by the laws of England and Wales. In the event of a dispute which cannot be resolved by Customer Services then you agree that the dispute will be dealt with exclusively by the courts of England and Wales.
